RISPOSTA DI PROXENTER ALLA CONSULTAZIONE ANAC

Linee guida attuative del nuovo Codice degli Appalti - Linee guida in materia di offerta economicamente più vantaggiosa (Documento di consultazione).

Paragrafo 5. “La valutazione degli elementi quantitativi

Le due formule presentate, al paragrafo 5 del documento in oggetto, come possibili modalità di calcolo dei punteggi economici  (Va=Ra/Rmax e la cosiddetta formula “bilineare”  cfr.  Par. 5  del  Documento di Consultazione), costituiscono 2 esempi di formule appartenenti alla famiglia delle formule “interdipendenti”, ovvero quelle formule che fanno dipendere i punteggi ottenuti da una offerta ad una qualche statistica della distribuzione della totalità delle offerte (ribasso massimo nel primo caso, ribasso massimo e medio nel secondo).  Le formule sopracitate oltre ad avere le caratteristiche descritte nel documento di consultazione ed il pregio di non richiedere alla stazione appaltante una stima precisa del valore della base d’asta e/o di valori soglia presentano anche alcune  importanti criticità:

Anti-Corruption Directive for subsidiaries companies of the Ministry of Economy and Finance (MEF):
Response of Proxenter to the Public Consultation set by the MEF. April, 15 2015 (available in Italian only)

The Directive aims at ensuring the proper implementation of existing legislation on anti-corruption and transparency. The Directive does not apply to issuers of financial instruments traded on regulated markets. Aware of the importance for the national economy of issuers’ subsidiary companies, the Ministry has launched a public consultation in order to obtain comments and contributions from all stakeholders.

Guidelines for the protection of whistleblower: response of Proxenter to the Public Consultation set by ANAC. March 16, 2015 (available in Italian only)

The National Anti-Corruption Authority aims at promoting the application of appropriate whistleblowing systems in all Italian public administrations. At the same time ANAC wants to identify suitable criteria for the protection of civil servant reporting misconduct, alleged dishonest or illegal activity occurring in an organization. To this aim, the Authority has prepared the Guidelines and opened a Public Consultation.

First Procurement Seminar organized by IFAD on behalf of the Common Procurement team of the Rome based Agencies in collaboration with the Center of Research in Procurement and Supply Chain (PROXENTER) and the International Master on Public Procurement Management of the University of Rome Tor Vergata

The first seminar will be held by Elisabetta Iossa, Professor of Economics at the University of Rome Tor Vergata and Director of PROXENTER. The Seminar will be focused on the “Procurement for Innovation”. It will describe the rationale for the intervention of public procurement to stimulate innovation, the complexities, opportunities and risks faced when dealing with innovative goods and markets, the existing procedures used in the EU in this field, and some insights on their possible application in procurement by international organisations.  The seminar will also include the discussion of some research works conducted by the University on these issues.

NEWS: 02nd July 2014th Collaboration agreement between Proxenter and Lear

Proxenter and Lear, a center for analysis in economics,  antitrust and competition policy (www. learlab.it), have entered into a collaboration agreement in the field of public and private procurement.
An efficient public procurement system is a powerful source of economic growth. The legal framework that oversees the purchasing activities of the State and the actual behavior of public procurers must be informed by the objectives of transparency and competition. These are essential factors to meet the current budgetary constraints and to foster the competitiveness of an economic system.
Thanks to their collaboration agreement, Proxenter and Lear will conduct researches on competition issues related to public procurement, and will carry out consultancy activities for public and private clients.
